SUBJECT:

REQUEST FOR STAY Of ISSUANCE Of THE LOW POWER OPERATING LICENSE FOR COMANCHE PEAK VNIT 2 On february 2, 1993, the NRC received an " Emergency Motion to Stay Issuance of Low-Power Operating License" (Motion). Thu Motion was filed by Kohn, Kohn and Colapinto. The Motion requested that the Commission 1) issue an order staying the issuance of the low power license; 2) grant petitioners the opportunity to review withheld documentation related to settlement agreements between TV Electric and the former minority owners of Comanche Peak; 3) stay issuance of the low power license until a final determination is made on the Construction Permit Amendment Proceedings for Unit 2; and 4) that petitioners be granted oral argument on their motion.  :

I have been advised by the Office of the General Counsel that a stay is not in effect. The staff and I have reviewed the Motion and determined that it does.

not identify any significant safety issues. The Petitioners have arovided no evidence of any safety concerns, but have only speculated that suc1 concerns may exist.
