SUBJECT: U.S. NUCLEAR REGULATORY COMMISSION ACKNOWLEDGEMENT OF DISPUTE OF NON-CITED VIOLATION 05000286/2016002-02

Dear Mr. Vitale:

I am writing to acknowledge receipt of your letter, dated September 29, 2016, written in response to the U.S. Nuclear Regulatory Commission (NRC) Integrated Inspection Report 05000247/2016002-02 and 05000286/2016002-02, issued on August 30, 2016.

Your letter requests withdrawal of the 10 CFR 50, Appendix B, Criterion V, "Instructions, Procedures, and Drawings," Green non-cited violation concerning the failure to follow the operability process as prescribed in Entergy procedure EN-OP-104, "Operability Determination Process." You stated that Entergy was in full compliance with procedure EN-OP-104 when evaluating the baffle former bolt condition discovered at Unit 2 as it applied to Unit 3. The NRC will review your response and provide you a letter documenting the basis for any decision within 90 days.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC's Public Document Room or from the Publicly Available Records component of the NRC's Agencywide Documents Access and Management System (ADAMS). Your letter has also been added to ADAMS for the information of the public, and may be found under ADAMS Accession Number ML16281A486.
