DISPUTE OF NON-CITED VIOLATION 05000286/2016002-02
Dear Mr. Vitale:
I am writing to acknowledge receipt of your letter, dated September 29, 2016, written in
response to the U.S. Nuclear Regulatory Commission (NRC) Integrated Inspection Report 05000247/2016002-02 and 05000286/2016002-02, issued on August 30, 2016.
Your letter requests withdrawal of the 10 CFR 50, Appendix B, Criterion V, Instructions,
Procedures, and Drawings, Green non-cited violation concerning the failure to follow the
operability process as prescribed in Entergy procedure EN-OP-104, Operability Determination
Process. You stated that Entergy was in full compliance with procedure EN-OP-104 when
evaluating the baffle former bolt condition discovered at Unit 2 as it applied to Unit 3. The NRC
will review your response and provide you a letter documenting the basis for any decision within
90 days.
In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be
available electronically for public inspection in the NRCs Public Document Room or from the
