CORRECTION TO 10-YEAR INSERVICE INSPECTION INTERVAL ENUMERATED IN RELIEF REQUEST 13R-02 ISSUED ON APRIL 30,2009 (TAC NO. MD8742)

Dear Mr. On April 30,

2009, the U.S. Nuclear Regulatory Commission (NRC) issued a safety (SE) related to Relief Request (RR) 13R-02 for the Shearon Harris Nuclear Power Unit NO.1 (HNP), in response to your request dated April 29, 2008, as supplemented by dated June 19, 2008, and January 9, Relief Request 13R-02 requested NRC authorization to extend the risk-informed inspection (RI-ISI) program plan to the third 10-year inservice inspection (lSI) interval at The HNP RI-ISI program was initially submitted to the NRC staff in a letter dated April 27, and was reviewed and approved for use during the second 1O-year lSI interval by letter March 8, 2006. The licensee's RR 13R-02 submittal proposed to extend the same process originally authorized for the second 10-year lSI interval to the third 10-year lSI An error was inadvertently included in the NRC staff's SE regarding the proper dates for third 10-year lSI interval at HNP. The statement was made in the SE that: "The April 29, 2008, submittal proposes to extend the same RI-ISI process originally authorized the second 10-year lSI interval to the third 10-year lSI interval, which began on May 2, and ends on May 1, However, HNP's third 10-year lSI interval is actually effective from May 2,2007, May 1,2017. Apparently, the confusion resulted from the 1-year extension that was taken, accordance with the provisions allowed by the American Society of Mechanical Engineers and Pressure Vessel Code, on the end date of the second 10-year lSI interval, which it until May 1,2008. This extension did not impact the beginning of the third 10-year lSI which remained May 2,

-2 Accordingly, this letter is to inform you that the NRC staff considers that the third 1O-year lSI interval at HNP is effective from May 2, 2007, through May 1, 2017, despite the dates contained in the RR 13R-02 SE. We regret any inconvenience this error may have caused. If you have any questions regarding this matter, please call me at (301) 415-3178.
