SUMMARY

RELATED TO THE REVIEW OF EXEMPTION REQUEST FROM CERTAIN REQUIREMENTS IN 10 CFR 50.55a(h)(2) (EPID L-2024-LLE-0004)

Dear Thomas Haaf:

By letter dated February 6, 2024 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24037A284), as supplemented letter dated April 3, 2024 (ML24094A105), Duke Energy Progress, LLC (Duke Energy) submitted a request for an exemption from certain requirements of Title 10 of the Code of Federal Regulations (10 CFR)

Section 50.55a(h)(2), Protection systems, for the Shearon Harris Nuclear Power Plant, Unit 1 (Harris).

Specifically, the exemption request would remove the requirement for the Reactor Protection System cables that terminate within the Turbine Control System Cabinet G (1TCS-CAB-G) to meet the requirement in the Institute of E lectrical and Electronics Engineers (IEEE) Standard (Std) 279-1971, Criteria for Protection Systems for Nuclear Power Generating Stations, Section 4.6, Channel Independence, that the cables be independent and physically separated.

The exemption request was submitted under the Risk-Informed Process for Evaluations (RIPE).

To enhance the review of the licensees request, the U.S. Nuclear Regulatory Commission (NRC) staff conducted a regulatory audit on May 22, 2024. A summary of the regulatory audit is enclosed. The NRC staff did not identify any si gnificant issues dur ing the audit. At the conclusion of the audit, the licensee informed the NRC that a supplement was to be sent to the NRC addressing the proposed audit questions and information requests, found in Section 5.0 of the audit plan dated April 22, 2024 (ML24113A252).

1.0 BACKGROUND

A regulatory audit is an activity undertaken by the U.S. Nuclear Regulatory Commission (NRC) staff to examine and evaluate licensee information with the intent to gain an understanding of, verify, or identify information that will require docketing to support the basis of a licensing or regulatory decision.

By letter dated February 6, 2024 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24037A284), as supplemented letter dated April 3, 2024 (ML24094A105), Duke Energy Progress, LLC (Duke Energy) submitted a request for an exemption from certain requirements of Title 10 of the Code of Federal Regulations (10 CFR)

The exemption request was submitted under the Risk-Informed Process for Evaluations (RIPE).

The NRC staff performed a preliminary review of the exemption request and determined that a regulatory audit would assist in the timely completion of the review. The NRC staff conducted a regulatory audit that included a discussion with the licensee on May 22, 2024. The audit plan was provided to the licensee on April 22, 2024 (ML24113A252).

2.0 AUDIT ACTIVITIES AND OBSERVATIONS

The remote audit was conducted using web-conferencing capabilities. The purpose of the audit was to (1) confirm internal licensee informati on that supports statements made in the exemption request, and (2) determine whether the information included in the documents is necessary to be submitted to support a safety conclusion.

Discussions on the topics identified in the attachment of the audit plan were held with the licensee during an audit call conducted on Ma y 22, 2024. The NRC staff assessed the information provided during the audit to determine whether additional information would be needed to support a regulatory finding, and therefore, would need to be submitted for review.

4.0 RESULTS OF THE AUDIT

At the conclusion of the audit, the licensee informed the NRC that a supplement was to be sent to the NRC addressing the audit plan dated April 22, 2024. The licensee provided a supplement dated June 7, 2024 (ML24159A746). The NRC staff has reviewed the supplement and determined that no additional information is required.
