SUBJECT:

CAROLINA POWER & LIGHT (CP&L) COMPANY'S SHEARON HARRIS UNIT 1 DOCKET NO. 50-400, STATUS OF FACILITY COMPLETION Based on the implementation of the prescribed NRC inspection program and other related inspection activities, we have determined that construction and preopera-tional testing of Shearon Harris Unit 1 bave been completed in accordance with the FSAR, other docketed connitments and regulatory requirements to the extent necessary for issuance of a Low Power License. Included in the Region II assess-ment was the review of the draft Shearon Harris Unit 1 Low Power License, dated October 1, 1986, and CP&L Status for Fuel Load letters of August 1 and September 29, 1986, requesting construction and preoperational testing exemptions. Region II has no issues with regard to these documents. We requested and received from l CP&L the status of completion letter dated October 3,1986. The letter is acceptable and consistent with our findings. There are a number of issues remaining to be resolved between issuance of the Low Power and the Full Power Licenses. Therefore, the enclosure to this memorandum, identifying these issues, is recommended as an 5 attachment to the Low Power License for Shearon Harris Unit 1. Also, we have j recently received several allegations that will possibly not be resolved prior to ,

issuance of the Low Power License. Therefore, these allegations have been reviewed pursuant to the NRC Statement of Policy: Handling of Late Allegations, dated March 19, 1985. Our review has determined that either these allegations would not be material to the low power licensing decision, even if true, or the allegations, if potentially material, are not new issues, in that similar concerns have been evaluated and found to be not substantiated. We will resolve these allegations prior to issuance of the Full Power License.

Based on the above, Region II recommends issuance of a Low Power License for Shearon Harris Unit 1. We have reviewed CP&L's preoperational and startup schedule to full power operation and find it acceptable. We will follow these activities, and the attached license conditions and keep you apprised of our findings during this. period.
