REQUEST FOR WAIVER OF FEE BILLING FOR THIRTEEN DOCKETS IN THE PILOT INSPECTION PROGRAM Your April 30,1999, memorandum requested a waiver of 10 CFR Part 170 fees for certain inspection efforts related to NRR's Pilot Regulatory Oversight Program (described in Commission papers SECY-99-007 and SECY-99-007A) that are in addition to the inspection efforts required by the current regulatory oversight process. NRR considers the pilot effort to be part of a regulatory oversight program that would ultimately affect all nuclear power plants.
You provided the following information: 1) the pilot program is a six-month effort (approximately June through December 1999) that will involve thirteen reactor plants (see attached); 2) the pilot i
plants will collect and report Performance Indicator (PI) data, be inspected by NRC under the new risk-informed baseline inspection program, have enforcement actions taken under the new enforcement policy and be assessed under the new streamlined assessment process;
- 3) lessons learned from this pilot effort will provide the staff an opportunity to refine and revise j
the new regulatory oversight processes as necessary prior to full program implementation; 4) full implementation of the new oversight process will commence pending successful completion of the pilot program; and 5) as a reFult of these inspections, some pilot plants may receive inspection effort in addition to that required by the current regulatory oversight process, including additional baseline inspections performed solely to adequately test the program.
Based on the foregoing, I have determined that the thirteen plants in the pilot program (extended by the Commission to a nine-monti; program) will be exempted from the 10 CFR Part 170 fees for the inspection efforts that are above the current requirements. This exemption is authorized ome by law and is granted in accordance with 8170.11(b)(1) of 10 CFR 170. Please assure that ali staff are instructed to use the inspection report number designated as non-billable to report their inspection effort that is above current requirements. The non-billable inspection report numbers should be provided to Ellen Poteat in the LFARB by e-mail (MEP1) or by telephone (301-415-6392).
