REQUEST FOR WAIVER OF FEE BILLING FOR THIRTEEN DOCKETS IN THE PILOT INSPECTION PROGRAM This memorandum requests a waiver of fees for the thirteen (13) dockets that will comprise the plant population for NRR's Pilot Regulatory Oversight Prograrn. The purposes of the pilot program have been described in Commission paper SECY-99-007 and SECY-99-007A.

Performance indicator (PI) data reporting and the revised inspection, assessm9nt, and enforcement processes will be implemented at the pilot plants. Lessons learned from this pilot effort will provide the staff an opportunity to refine and revise the new regulatory oversight processes as necessary prior to full program implementation.

The pilot program will be a six-month effort that willinvolve plants from each region. The plants selected (see below) represent a cross-section of design and licensee performance across the industry. The pilot plants will collect and report Pi data, be inspected by the NRC under the new risk-informed baseline inspection program, have enforcement actions t: ken under the new enforcement policy, and be assessed under the new streamlined assessment process.

Calhoun Omaha Public Power District IV Cooper Nebraska Public Power District The objectives of the pilot program are to: (1) evaluate the functional efficiency of the concept, (2) identify problems and make appropriate changes prior to full implementation, and (3) evaluate the effectiveness of the new processes. The pilot program will also measure agency and licensee resources required to implement the new oversight program. Full implementation of the new oversight processes will commence pending successful completion of the pilot program, as measured against pre-established success criteria.

2 NRR considers the pilot effort to be part of a regulatory oversight program that would ultimately affect all nuclear power plants. During the pilot implementatiori period -- approximately from the L

beginning of June to the end of December, the staff intends to perform each new baseline inspection procedure at least once in each region. This may result in some pilot plants receiving inspection effort in addition to that required by the current regulatory oversight process. NRR proposes that the effort at the pilot plants above current requirements not be billable. Such non-billable effort would include any additional baseline inspection performed solely to adequately test the program; according to our agreement with the OCFO , NRR will capture non-bilfable effort in a separate inspection report and will inform the OCFO staff that these inspection reports should be non-fee billable. However, any follow-up activities at specific plants, including regional initiative performed to address licensee performance and enforcement actions, would be fee billable to the licensees.
