Dear Chairman Palladino:
It is my understanding that in the near future the NRC will act on the latest application by the Department of Energy to bypass the normal i nuclear licensing procedures for the Clinch River Breeder project.
Serving on the Energy and Environment Subcommittee of the House Interior Committee has allowed me the opportunity to study in-depth many nuclear policy issues. One such issue is the development of breeder technology, ,
especially as it relates to the Clinch River demonstration project.
In reviewing the Clinch River project, both from a technological and a fiscal standpoint, I have come to the conclusion that the Clinch River project is unnecessary from an energy policyEvidently,, standpointmany and of further my is '*
an imprudent expenditure of taxpayer money.
Colleagues agree with my assessment; witness the vote by 186. members last year to delete funding for the Clinch River project.
Despite the Congressional concerns as expressed by the House vote, we are now witnessing an attempt by DOE to bypass normal licensing procedures in an effort to speed up the project's construction, which after 10 years, has yet to begin in earnest. I have seen no compelling reason for the Commission to agree to this request, especially in view of the fact that the Commission has twice previously turned down similar DOE licensing exemption applications. As you are probably aware, efforts <
are being undertaken in the NRC Authorization legislation to provide for reforms . i.n the nuclear.. licensing process. Approval of the exemption would fly in the face of these efforts to enact credible reforms.
Given the repeated attempts at licensing speed-up by DOE, I believe the Commission's acceptance at this time would set a poor precedent by which to judge the future exemption requests of other parties.

I urge the Commission to reject the Department of EnerEy's licensing cxemption request.

Thank you for your July 7,1982 letter requesting information on a constituent's behalf concerning NRC's environmental assessment of the Clinch River Breeder Reactor Plant.
There have been a number of changes pertinent to this assessment that have occurred since the Clinch River Breeder Reactor Plant Environmental Statement (HUREG-0139) was issued in February 1977. We have been assessing these changes and their environmental significance'from the i
time licensing activities for the Clinch River Plant were resumed in the fall of 1981. The results of that assessment will be documented in a report which is scheduled to be issued soon. ~

Dear Mr. Palladino:
I understand that the Department of Energy has applied to the Nuclear Regulatory Commission to conduct site preparations for the Clinch River Breeder Reactor. It is my contention that this project is unnedded, outmoded and unjustifiable.
As you may know, I was among the ninety-one House Members who signed a letter to President Reagan requesting that federal funding be withdrawn

for the Clinch River Breeder Reactor. I have little doubt that support for this project in the House is as scant as the tenable arguments in favor -
of this project. The assumptions that launched the plan to construct a demonstration breeder reactor have proven inaccurate. Consequently, I see no reason to pursue this unworthy pork barrel project. It is my hope that the NRC will reject the Department of Energy request and . . .
help our-taxpayers save two and one half billion dollars.
