Januaar 13, 1984 Director of Inspection and Enforcement U.S. Nuclear Regulatory Commission Washington, DC 20555 Dear Sir Due to the failure of the U.S. Congress to appropriate additional funds, the U.S. Department of Energy has terminated the Clinch River Breeder ~ Reactor Plant (CRBRP) Project.
Consequently, the DOE is no longer seeking a Construction Permit from NRC and is closing out all Project licensing activities.
I wish to inform you of the DOE's receipt and storage, through our contractor the Stone and Webster Engineering Corporation (SWEC), of the spent fuel transfer port assembly (SPTPA) large shield plug, which was to have been a component installed in the CRBRP.
The device contains about 4.5 tons of depleted uranium (D.U.) encased in steel.
It is labeled with the Department Of Transportation label, stating the D.U. contents of 0.126 Curies.
By virtue of 10CFR40.11 the DOE is exempt from licensing.
There-fore, I am not sending NRC Form 244, but am informing you of receipt and other actions by this letter.
The SPTPA was f abricated by the Newbrook Machine Corporation of Silver Creek, New York under the New York agreement-state license
- 307-0413, amendment No. 11.
Shipping and receipt was withcut any incident which might have been detrimental to the containment of the D.U.,
and the device is in excellent condition and presently stored in a warehouse located on thc DOE Oak Ridge reservation.
A radiation survey made by the. health physicist on my staff showed no significant exposure-rate and an absence of any transferable contamination.

As you are aware, the Department's Safety and Environmental Control-Division has health physicists on its staff.
Therefore, I hereby inform you that surveillance by them, or others contracted for, over the SFTPA until its final disposal will be not,less.than that required by 10CFR40.25.
