RE:   Karl, Got your phone message. We did think about the potential need for O&A on this letter and opted not to process under O&A. RIS 2001-018 contains some guidance related to this topic. The attached is an excerpt from the RIS:

Docketed submittals related to applications, license amendments, supplemental information, and responses to RAIs that will be used by the NRC staff to prepare a safety evaluation and to approve or deny an amendment to a license must be provided under oath or affirmation or an unsworn declaration. Relief requests, exemption requests, and responses to generic communications do not need to be submitted under oath or affirmation unless explicitly requested by the Commission. While the letter I sent is related to an LAR, we believe that the letter will not be used by the staff to prepare the safety evaluation or as information to approve/deny the amendment. Rather, we view this letter as an administrative activity that has no effect on the technical content of the LAR and does not weigh in on any decision related to the acceptability or non-acceptability of the technical content of the LAR.
