By letter dated February 25, 2013 (ADAMS Accession No. ML13058A065) Dominion Energy Kewaunee, Inc.
(DEK, the licensee) certified, consistent with 10 CFR 50.4(b)(8), that it would permanently cease power operations of KPS on May 7, 2013. ML13058A065 docketed in ADAMS on February 27, 2013. On May 7, 2013, DEK permanently ceased operations at KPS.
In a letter dated May 14, 2013 (ADAMS Accession No. ML13135A209) DEK certified, consistent with 10 CFR 50.4(b)(9), that as of May 14, 2013, all fuel had been permanently removed from the KPS reactor vessel and placed in the spent fuel pool. ML13135A209 docketed in ADAMS on May 15, 2013.
Thus on May 15, 2013, KPS satisfied the conditions of certification described in 10 CFR 50.82(a)(2), and the 10 CFR part 50 license no longer authorized operation of the reactor or emplacement or retention of fuel into the reactor vessel.
