KEWAUNEE POWER STATION - WITHDRAWAL OF LICENSE AMENDMENT REQUEST (TAC NO. ME7250)

Dear Mr. Heacock:

By letter dated September 21, 2011 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML11277A240), Dominion Energy Kewaunee, Inc (DEK, the licensee) applied for a license amendment for the Kewaunee Power Station. The proposed amendment would adopt National Fire Protection Association (NFPA) Standard 805, "Pertormance-Based Standard for Fire Protection for Light Water Reactor Electric Generating Plants," 2001 Edition, in accordance with Section 50.48(c) of Title 10 of the Code of Federal Regulations (10 CFR 50.48(c>>. Subsequently, by letter dated January 13, 2012 (ADAMS Accession No. ML12020A244), you withdrew the amendment request.

The purpose of this letter is to advise you that the above-cited application is being treated as a withdrawal from NFPA 805 transition. Notice of Consideration of Issuance of the proposed amendment had not been published in the Federal Register.

Because you withdrew your amendment request, enforcement discretion, as described in Section 9.1 of the NRC Enforcement Policy (ADAMS Accession No. ML093480037), may continue to apply for noncompliances that you have corrected or intend to correct, if reasonable and timely corrective actions are in progress. Otherwise, enforcement discretion granted under this Interim Enforcement Policy is no longer applicable and enforcement action will be taken in accordance with the Enforcement Policy. However, certain noncompliances may still receive enforcement discretion, as described in the Enforcement Guidance Memorandum 09-002, "Enforcement Discretion for Fire Induced Circuit Faults" (ADAMS Accession No. ML090300446).
