Although formal offsite emergency plans have typically been exempted for decommissioning sites, State and local organizations continue to be relied upon for firefighting, law enforcement, ambulance and medical services. Please explain why this requirement would not be applicable.

Zion requested similar wording to the NRC RAI wording in their exemption request:

(1) Primary responsibilities for emergency response by the nuclear facility licensee and by State and local organizations within the Emergency Planning Zones have been assigned, the emergency responsibilities of the various supporting organizations have been specifically established, and each principal response organization has staff to respond and to augment its initial response on a continuous basis.

The corresponding, current EPlan for Zion is publically available from ADAMS Accession No. ML102720126.

Section 4.6 reads:

4.6 STATE AND LOCAL GOVERNMENT RESPONSE State and local government agency response will be in accordance with each agency's plans and procedures, and commensurate with the hazard posed by the emergency. Letters of Agreement are in place for those local agencies that will respond to the site, and for the hospital that will treat a contaminated injured individual from the site.

Arrangements are in place through Letters-of-Agreement for police, fire, hospital and ambulance response as requested by the station.

This wording has been approved by the NRC staff throughout the history of the Zion defueled EPlan changes.
