AND REQUEST FOR PRODUCTION OF DOCUMENTS OR, IN THE A1TERNATIVE, MOTION FOR ISSUANCE OF SUBPOENA On September 23, 1988, the Town of Merrimac filed a "Motion for Protective Order And Objection To NRC Staff Interrogatories" (Attachment 1 l hereto), in response to the NRC Staff's first set of interrogatories and request for production of documents.1/ In its Motion, the Town objected and flatly "declined" to provide a response to any of the 28 interrogatories and document requests contained in the Staff's Interrogatories, "unless required to by order of the Nuclear Regulatory ; | |||

NRL STAFF'S MOTION TO COMPEL RESPONSE BY TOWN OF MERRIMAC TO THE STAFF'S FIRST SET OF INTERROGATORIES ,
AND REQUEST FOR PRODUCTION OF DOCUMENTS OR, IN THE A1TERNATIVE, MOTION FOR ISSUANCE OF SUBPOENA On September 23, 1988, the Town of Merrimac filed a "Motion for Protective Order And Objection To NRC Staff Interrogatories" (Attachment 1 l hereto), in response to the NRC Staff's first set of interrogatories and request for production of documents.1/ In its Motion, the Town objected and flatly "declined" to provide a response to any of the 28 interrogatories and document requests contained in the Staff's Interrogatories, "unless required to by order of the Nuclear Regulatory ;
Comi ssion. " For the reasons set forth below, the the Town of Merrimac's ,
Motion should be denied, and it should be compelled to provide a complete I and proper response to the Staff's Interrogatories pursuant to 10 C.F.R I 6 2.740(f). In the alternative, if the Board should conclude that the Town is not required to respond to discovery, the Staff hereby requests

q In support of its refusal to provide discovery, the Town alleges, without any substantiation whatsoever, that the discovery sought by the Staff "is unduly burdensone and costly to [the Town)," and "is disruptive '
to record keeping maintained by the Town". Merrimac further asserts that

It is well established that a party is entitled to receive direct answers or objections to each and every interrogatory it may propound in discovery. Objections should be plain enough and specific enough so as to allow the requesting party and Board to understand why the interrogatories are claimed to be objectionable. General objections are insufficient,

Further, a request for documents should not be deemed objectionable merely l

9 r l Merrimac's assertion that it need not respond to discovery requests because it is a "contentionless intervenor" is without merit. A State or municipal government is permitted to participate in an NRC proceeding without having to file its own contentions, pursuant to 10 C.F.R. '
! 2.715(c). Howev *, once admitted to the proceeding, it is obliged to I comply with the same procedural rules and requirements as are applicable to parties in the proceeding. See, e.g., Gulf States Utilities Co. (River Bend Station, Units 1 & 2), ALAB-444, 6 NRC 760, 768 (1977), a f firming LBP-76-32, 4 NRC 293, 294 (1976); Illinois Power Co. (Clinton Power l Station, Unit No. 1), LBP-82-103, 16 NRC 1603, 1615 (1982). ,
Having elected to participate in this proceeding pursuant to 10 C.F.R. 5 2.715(c), the Town of Merrimac should be required to respor) to i
- discovery filed against it by other parties to the proceeding. At the
- present time, Merrimac has not yet specified the extent of its inticipated 3
participation in the litigation, nor has it yet identified the particular issues in which it is interested; at the same time, the Town has already entered an appearance before the Board, and 3ppears to be intent on participating fully in the forthcoming litigation. The Licensing Board in
- this proceeding has previously determined that other towns participating under 10 C.F.R. 5 2.715(c) should be required to respond to certain i

capability which it possesses are directly relevant to the protective reasures which may be available for its residents in the event of an energency; and that its present refusal to participate in emergency planning for Seabrook necessitates that its emergency plans, resources, ,
and likely response to an emergency be fully explored in the discovery phase of this proceeding.
CONCLUSION The Town of Merrimac has completely disregarded its obligation to make a reasonable, bona fide effort to respond to the Staff's Inter-rogatories. For the reasons set forth above, the Town should be compelled to file a complete and proper response response thereto. In the alternative, a subpoena should issue, directing the Town to respond to the Staff's Interrogatories.
