As previous 2y observ6J in the Intervenors Reply to the Appeal Board Order of February 22, 1991, the inspection report does not contain information as to specifically what stops the on-site operators took to moet tha challenges presented in the December 1990 exerciso. The Fox affidavit adds virtually no information to that provided in the inspection report. The Fox affidavit simply walks through the inspection report and references portie.9? of it as being responsive to woaknesses identified IR Ho. 50-443-88-09. The Fox affidavit does not on its face directly address the criticisms leveled in the two affidavits of Robert pollard previously sutgitted in connection with the 1928 on-sito exerciso contention. The Fox affidavit does not provido any additional specific information cs to what transp' d in the December 1990 exercine btyond what is contained in the inspection report. For examplo, in his af fidavit Fru states:

" Among the specific activition observed during a 1990 exerciso were the assessment and projection of of f-site radiological doser and consideration of protective actions. The NRC btaff listed as exerciso strengths (areas which provide strong possible indication of the ability to cope with abnormal plant conditions and implomont the plan) the ability of TSC Staf f to tron 6 and extrapolato data, anticipato problems and actually predict when conditions would be reachnd justifying the declaration of a Site Area Emergency." The Fox a f fidavit c.'. 5.

In his affidavit Mr. Fox does not provido any information as to what stops are taken by the on-site staf f to assess and project off-site radiological dosos, nor is any information provided as to what analysos were nado in considering protectivo actions.

k any exanples of what problema vere purportedly anticipated by them, or e*,idenco provided to show that they made accur?to predictions. In sun, the Fox affidavit provides no now information about the December 1990 exorcise that is not readily apparent from reading the exorcise report.

If the NRC Staf f and Licansees actua11 bellove that the 1990 exorcibe has rondered moot the issue resanded by the Court of Appeals, they should file the appropriato motions and supply the requisito evidentiary basis that will allow this Board to make an informed decision on the matter.
