. APPEAL OF LBP-49-38 Now come the Licensees and say as follows:

1. The Appeal-Board currently has agh iudice an appeal from the decision of the Licensing Board denominated LBP-89-38.

Public Service Comoany of New Hamoshire (Seabrook. Station, Units 1 and 2), LBP-89-38, 30 NRC 725-(3989).

2.- This decirion denied three motions filed by-Intervenors

-herein which motions sought-the acceptance.for-litigation of two contentions allegedly arising out of the'onsite emergency plan exercise held at'the Seabrook Nuclear Power Station (Seabrook) cn1 September 27,~1989 ("the Exercise").

4. This ruling by the court means that as a matter of law, -

the events which occurred at the Exercise, and the Exercise, i

itself are not material matters with respect to the issuance of

.Seabrook's operating license. . Egg Commonwealth of Massachusetts v. hrs, suora, Slip op. at 36-37, 40-41; Union of Concerned Scientists v. HRG, 735 F.2d 1437, 1443-48 (D.C. Cir.

1984). This being the case,.the Intervanors had no right to a hearing.on the contentions which they proffered with respect to

.the' Exercise.

5. In' light:of all of the foregoing,-the appeal of LBP-

-89"38 should be dismissed either assmoot or on the-grounds-that, sas a-matter of law,' the Licensing Board was correct in denying.a hearing with respect to the contentions at issue.
