MASSACHUSETTS ATTORNEY GENERAL'S RESPONSE TO IllE_AFPEAL BOARD' S ORDER OF MARCH 11. 1991 In'an orde; dated March 11, 1991 the Appeal Board observed that one of the open issues still pending on appeal.is the Licensing Board's rejection of the Dillman/Moriearty testimony.

The Appeal Board noted that-at one time Applicant's Counsel ,

offered to: retain Dr. Dillman to design a-proper' survey, and nent

-on to suggest that if that offer:was-still available, it might be a suitable compromise in settlement of the question of the-

-exclusion' of the Dillman/Morlearty testimony.

The Applicants have:fi-led a-response to_the Appeal Board's' Lorder in which they make the following proposal:-

The_ Mass AG v..epts tnat proposal in aettlement of ita appeal'of the Licensing Board's evidentiary ruling excluding the Dillman/Moriearty testimony. In doing so-the Mass AG specifically limits the acceptance to settling only-the exclusion the Dillman/Moriearty testimony. No other issue still pending on appeal is resolved by this compromise. The Mass AG still maintains the Licensing Board's finding of adequacy with respect to the special needs survey litigated in the hearings on the SPMC was erroneous. The Mass AG continues to adhere to the position that since the special needs survey f performed prior to the licensing decision was inadequate, a full power license should not have issued. The license should be vacated until such time as there'is evidence of a survey L

measures for-the resident special needs popu2ation.
