Nuclear Regulatory Commission Attention: Document Control Desk Washington, DC 20555 South Texas Project Electric Generating Station Unit 1 Docket No. STN 50-498 First Quarterly Installment of Fiscal Year 1988 Annual Fee Pursuant to 10CFR Part 171 In accordance with the direction contained in Invoice No. G0053, Houston Lighting & Power Company (HL&P) has made payment of the first quarterly installment of the Fiscal Year 1988 annual fee pursuant to 10CFR Part 171 with respect to the South Texas Project, Unit 1 by electronic transfer of funds.

In our view, the regulations pursuant to which the payment was made are illegal. HL&P has instituted litigation challenging the regulations in the United States Courts of Appeals for the District of Columbia Circuit.

Nevertheless, e.g.,

the payment was made in order to avoid several sanctions (see, 10CFR171.23) that may be imposed upon HL&P for not making it.

This payment under 10CFR171.23 was not made voluntarily and was made under protest.
