Dear Mr. Stello:

The Long Island Lighting Company's letter of November 7, 1986 (SNRC-1288) requested an exemption of payment of the annual license fee under 10 CFR 171 for the Shoreham Station.

In response to SNRC-1288, on April 20, 1987 the NRC granted LILCO an exemption from the licensing fee to extend through FY 1987 or until a license is issued to operate the Shoreham Nuclear Power Station above 5% of rated thermal power.

At present, it appears that Shoreham will not receive approval to exceed 5% of rated thermal power until after September 30, 1987, the end of FY 1987. Since the reasons outlined in SNRC-1288 supporting an exemption are still valid, LILCO requests that under 10 CFR 171.11, LILCO be granted an extension of the license fee exemption during FY 1988 or until Shoreham is licensed to exceed 5% of rated thermal power.

As recognized in your April 20, 1987 letter, LILCO has had a license for Shoreham operation since December, 1984, but we have not been authorized to exceed 5% power due solely to the refusal of State and local' governments to participate in emergency planning. As your letter acknowledged, in addition to not being able to produce marketable electric power at Shoreham, the protracted licensing' proceedings caused by State and' local  !

In'the event that Shoreham is licensed to operate above 5% of rated thermal power.in FY 1983, LILCO understands that the requested fee exemption would be lifted and that payment of the fee would be prorated.through the remainder of FY 1988 and would be payable in full thereafter.
