Gentlemen:

LILCO hereby reaffirms its commitment not to place nuclear fuel

-back into the Shoreham reactor without prior NRC approval.

LILCO agrees to a requirement to never place fuel back into the Shoreham reactor, without the prior establishment of an offsite emergency response organization comparable in effectiveness to the Local Emergency Response Organization, which the NRC approved sprior_to issuance of LILCO's full power operating license, NPF-82.

As you know, LILCO has agreed with New York State never to operate the Shoreham Nuclear Power Station, and to transfer it to the Long Island Power Authority for decommissioning. That commitment remains in effect, and LILCO has taken certain preliminary steps, none of them irreversible, to lower ongoing costs.
