As you know, the Long Island Lighting Company (LILCO), holder of Facility Operating License NPF-82, has agreed not to operate Shoreham Nuclear Power Sation, Unit 1 (Shoreham) and to transfer Shoreham to the Long Island Power Authority (LIPA) , in certain agreements involving LILCO, LIPA, the State of New York, and the

-New York Power Authority (NYPA). LIPA likewise will not operate Shoreham as a nuclear facility; it will safely maintain Shoreham

' in its present defueled and non-operating condition pending submission to and approval by the Nuclear Regulatory Commission 3'

(NRC) of a plan to decommission Shoreham pursuant to 10 CFR 50.82.

Pursuant to 10 CFR 50.80 and 50.90, LILCO and LIPA have' enclosed tho' Joint Application of LILCO and LIPA for License Amendment to Authorize Transfer of Shoreham. The Joint Application, consisting of a main body and five appendices, specifically 3 requests that License No. NPF-82 be amended to designate LIPA as E the Shoreham licensee upon or after the NRC's amending of License No. NPF-82 to a non-operating status.

To facilitate review of the requested amendment, Appendix A contains a mark-up of License No. NPF-02, in the Defueled Facility Operating License status proposed by LILCO's submittal of January 5, 1990, (Application to Amend operating License NPF-82, January 5, 1990, transmitted by letter SNRC-1664). Appendix B contains a mark-up of Section 6 of the Shoreham Technical Specifications proposed by LILCO in its January 5, 1990 filing. These two mark-ups indicate the changes in License NPF-82 and the Shoreham Technical Specifications

-necessary to reflect assumption of licensed duties and obligation by a new licensee (LIPA) with a new organization and personnel.

Appendix C provides details concerning LIPA's Shoreham Project organization, including key personnel. Appendix D shows that the proposed amendment involves no environmental impacts. Finally, Appendix E sets forth a "no significant hazards consideration" analysis demonstrating that the proposed amendment should be issued and made effective upon issuance purauant to 10 CFR 50.91.

As indicated at the May 24, 1990 meeting of representatives of the NRC Staff, LILCO, LIPA, and NYPA, LILCO and LIPA are prepared to work cooperatively with the NRC Staff to facilitate consideration of the Joint Application. Accordingly, we would be pleased to meet at a technical or management level to discuss matters related to the Joint Application.
