NOTICE OF VIOLATION Northeast Nuclear Energy Company . Docket No: 50-423 Millstone Nuclear Power Station, Unit 3 License No: NPF-49 During an NRC inspection conducted on March 2 - 31,1998, violations of NRC requirements were identified. In accordance with the " General Statement of Policy and

. Procedure for NRC Enforcement Actions," NUREG-1600, the violations are listed below:

A. License Condition 2.H, Fire Protection, of Facility Operating License NPF-49, for the Millstone Nuclear Generating Station, Unit 3, states, in part, " Northeast Nuclear Energy Company shall implement and maintain in effect all provisions of the approved fire protection program as described in the Final Safety Analysis Report for the facility and as approved in the SER (NUREG - 1031) issued July 1984 and Supplements Nos. 2,4, and 5 issued ..."

Section 9.5.1, Fire Protection System, Subsection 9.5.1.3 Safetv Evaluation, of the Final Safety Analysis Report states that the Fire Protection Evaluation Report Section 5, " Fire Hazards Analysis," contains detailed evaluations of each fire area within the facility.

Section 5.3.1, " Fire Hazards Analysis," of the Fire Protection Evaluation Report states, " Fire areas are established on the basis of buildings that are separated from other areas by boundaries (walls, floors, or roofs) that have at least 3-hour ratings for safety-related structures ..." Figure 77F in the Fire Hazards Analysis shows the floor slab separating the control room from the cable spreading room as a fire area boundary.

Specification No. SP-CE-248, Rev.1, " Specification for Fireproof Coatings at Millstone Unit 3," requires steel members supporting a fire barrier to be protected to meet the same criteria as the fire barrier.

l Contrary to the above, structural steel support members did not meet the 3-hour fire barrier criterion, in that on and before March 4,1998, columns D2-54, D2-53, and A4-52, supporting the 3-hour rated control room floor slab, had gaps in the fire rated coating of the column flanges.

l . This is' a Severity Level IV violation (Supplement I ).

B. License Condition 2.H, Fire Protection, of Facility Operating License NPF-49, states,

'in part, " Northeast Nuclear Energy Company shall implement and maintain in effect all provisions of the approved fire protection program as described in the Final Safety Analysis Report for the facility and as approved in the SER (NUREG - 1031) issued July 1984 and Supplements Nos. 2,4, and 5 issued ..."

Section 9.5.1, Fire Protection System, of the Final Safety Analysis Report states, part, "A fire protection program has been established by an administrative control procedure at Millstone Unit 3."

2 Revision 1 to the Fire Protection Program Manual, Section 4.7.8, " Corrective Actions," states, " Measures are established to ensure that conditions adverse to fire protection such as failures, modifications, deficiencies, deviations, defective components, uncontrolled combustible material and nonconformances are promptly identified, reported and corrected."

Contrary to the above, a deficiency was not properly corrected in that, in January 1998, when the vital alternating current power panels were found to be susceptible to multiple high impedance fault currents which could result in blowing the main power supply fuses, corrective actions were not adequate to permit reenergizing the nuclear instrumentation on the Alternate Shutdown Panel without resorting to repairs.

This is a Severity Level IV violation (Supplement l ).

Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). this reply should be clearly marked as a " Reply to a Notice of Violation" and should i.1clude for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation or severity level, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the j correspondence adequately addresses the required response, if an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.

If you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.
