I NOTICE OF VIO! ATION Northeast Nuclear Energy Company Docket No. 50-423 l Millstone Nuclear Power Station License No. NPF-49 Unit 3 - EA 98-166 During an NRC inspection conducted February 23 through March 6,1998, violations of NRC requirements were identified. In accordance with NUREG-1600, " General Statement of Policy and Procedure for NRC Enforcement Actions," the violations are listed below:

A. 10 CFR, Part 50, Appendix B, Criterion XVI, " Corrective Action," requires, in part, that conditions adverse to quality are promptly identified and corrected.

Technical Specification (TS) 4.5.2.c'.2 requires that each emergency core cooling system subsystem be demons'irated operable at least once each refueling interval by a visual inspection of the containment sump and verifying that the subsystem suction inlets are not restricted by debris and that the sump components (trash racks, screens, etc.) shows no evidence of structural distress or abnormal corrosion.

Contrary to the above, the following examples were identified where the requirements of 10 CFR, Part 50, Appendix B, Criterion XVI, " Corrective Action," were not met:

1. As of March 6,1998, the corrective action implemented to improve the containment sump inspections identified in Licensee Event Report (LER) 50-423/96-039-00, " Recirculation Spray and Emergency Core Cooling Systems Potentially Inoperable Following a Postulated Loss of Coolant Accident Due to Existing Debris in Recirculation Spray System (RSS) Sump and improper -

Configuration of Sump Cover Plates," dated November 14,1996, failed to include in the procedure SP 3612A.1, " Containment Closeout inspection," Revision 13, Change 1, dated March 21,1997, the containment sump inspection requirements specified in Technical Specification (TS) 4.5.2.d.2.

2. The corrective action to implement a procedure to ensure that the RSS sump cover plates l were properly installed, identified in LER 50-423/96-039-00, was not implemented. Maintenance L

Form 3704A-727, Preventive Maintenance Technique RSS Sump Cover Plate Removal and Installation, dated July 3,1997, was developed and issued but the use of Maintenance Form 3704A- i 727 was not specified in the RSS sump cover plate installation work order dated March 1,1998; therefore, the instructions !n Maintenance Form 3704A-727 were not being used.

This is a Severity Level IV violation (Supplement 1). (01014)

B. 10 CFR, Part 50, Appendix B, Criterion XVI, " Corrective Action," requires, in part, that conditions adverse to quality are promptly identified and corrected.

Contrary to the above, the corrective action specified in Condition Report M3-97-1557, dated May 21, 1997, to revise documents to reflect the circuit relay setting change for quench spray pump l' 3QSS*P3B were incomplete. As of March 1,1998, the twitchgear vendor drawings for the 4.16KV switchgear 3 ENS *SWG-A/B (Drawings 25212-31525, sheet 6, 2512-39010, sheet 418, and 25212-39010, sheets 447 and 460) were not revised to reflect the relay setting change. ' relay setting change but was not entered into the Control Document Library copy of Specification SP-EE-321.

Pursuant to the provisions of Title 10 of the Code of Federal Regulations (10 CFR), Section 2.201, Northeast Nuclear Energy Company is hereby required to submit a written statement or explanation l to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C.

This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each l

violation (1) the reason for the violation, or, if contested, the basis for disputing the violation or l

severity level, (2) the corrective steps that have been taken and the results achieved. (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the conespondence adequately addresses the required response. If an adequate reply is not roceived within the time specified in this Notice, an Order, or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be  !
