NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket No. 50-336 Millstone Nuclear Power Station Unit 2 License No. DPR-65 During an NRC inspection conducted on March 15 through April 2,1993, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:

Part 50 of Title 10 of the Code ofFederal Regulations, Appendix B, Criterion XVI, Corrective Action, requires measures shall be established to assure that conditions adverse to quality, such as failures, malfunctions, deficiencies, deviations, defective material and equipment, and nocconformances are promptly identified and corrected.

In the case of significant conditions adverse to quality, the measures shall assure that the cause of the condition is determined and corrective action taken to preclude j

repetition.

Contrary to the above, as of March 17, 1993, the measures to assure conditions adverse to quality were not taken to promptly identify and correct deficiencies as evidenced by the foUcwing: (1) NRC notification on August 29,1984, and February 24,1986, to avoid the potential for rendering all emergency diesel generators (EDG) unavailable by paralleling one or more EDGs to the grid while the remaining EDG(s) were inoperable, and (2) on January 7,1987, the licensee had experienced a situation where both EDGs were rendered inoperable for 56 minutes due to an event which occurred while the "A" EDG was declared inoperable and the "B" EDG was paralleled with the grid. In spite of these notices and the previous failure, the licensee continued to load one EDG in parallel with the grid during testing while the other EDG was declared inoperable. In addition, on March 17,1993, while the plant was at full power, both'EDGs'were loaded in parallel with the grid for more than one hour.

This is a Severity Level IV violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATrN: Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). Violation" and should include, for each violation: (1) the reason for the Violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued to show cause why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is-shown, consideration will be given to extending the response time.
