[ ENCLOSURE 1 NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket No.: 50-336;50-423 Millstone Nuclear Power Station, Units 2&3 License Nos.: DPR-65; NPF-49 During an NRC inspection conducted from December 1,1997 through December 31, 1997, violations of NRC requirements were identified, in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600,the violations are listed below:

A. Criterion V of 10 CFR 50, Appendix B, requires that activities affecting quality be prescribed by instructions or procedures of a type appropriate to the circumstances.

Further, it requires thet these activities be accomplished in accordance with these instructions or procedures.

Section 12.8 of the Millstone Nuclear Power Station Unit 2 Final Safety Analysis Report states that the Northeast Utilities Quality Assurance Program (NUQAP)

Topical Report complies with the requirements set forth in Appendix B of 10 CFR Part 50.

Appendix D to the NUQAP Topical Report states that the NUQAP is committed to ,

utilize the guidance of Regulatory Guide (RG) 1.39," Housekeeping Requirements for j Water Cooled Nuclear Power Plants."

Administrative procedure OA 8, Rev. 2. " Ownership, Maintenance, and Housekeeping of Site Buildings. Facilities, and Equipment," implements the guidance of RG 1.39 at Millstone Nucicar Power Station. Section 1.9 of procedure OA 8 requires restraint of equipment located in safety-related areas in accordance with Attachment 3 to procedure OA 8.

Contrary to the above, on December 22,1997, the NRC found that equipment (including 8 filing cabinets, a copier, and a book cart) located in a safety-related area, the Unit 2 cor. trol room, was not restrained in accordance with Attachment 3 to procedure OA 8, which could have resulted in the seismic interaction of this equipment with safety-related electrical panels, such as the reactor protection system cabinets and the engineered safety features actuation system cabinets.

This is a Severity Level IV violation (Supplement 1) for Docket No. 50-336.

B. Technical Specification 6.8.1.d requires that written procedures be established, implemented, and maintained covering surveillance activities of safety related equipment.

Contrary to the above, written procedures were not established to implement surveillance testing of all safety related logic circuitry as evidenced by the following examples:

Enclosura 1 2 On February 6,1997, the NRC determined that surveillance procedures did riot test ,

all contacts in the degraded voltage and undervoltege logic circuits.

On February 13,1997 the licensee determined that surveillance procedures did not fully test the logic circuits for several Auxiliary Foodwater System valves.

On May 23,1997, the licensee determined that surveillance procedures did not completely test the automatic isolation function of Supplementary Leak Collection and Release System intake and exhaust dampers.

On September 10,1997, the licensee determined that surveillance precedures did not cdequately test the automatic start of the control room chillers and instrument and computer room air conditioning units during a simulated loss of power test.

This is a Severity Level IV violation (Supplement l} for Docket No. 50 423.

For Violation A above and pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit a written statement or explanation within 30 days of receipt of the letter transmitting this Notice of Violation (Notice) to the U.S.

Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Director, Special Projects, Nuclear Reactor Regulation and a copy to the NRC Resident inspector at the facility that is the subject of this Notice. This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1):he reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence,if the correspondence adequately addresses the required response. If an adequate reply is not received within the required time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended. or revoked, or why such other action as may be proper should not be taken.

Where good cause is shown, consideration will be given to extending the response time.

For Violation B only, the NRC has concluded that information regarding the reason for the vio!ation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance will be achieved is already adequately addressed on the docket in Licensee Event Report 97 017-00(including supplements 01 and 02) and your letter to *e NRC dated April 3,1997, " Updated Response to Generic Letter 96 01 Testing of f afety related logic Circuits." However, you aro required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark yoiir response as a " Reply to a Notice of Violation,"

and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Director, Special Projects, Nuclear Reactor Regulation and a copy to the NRC resident inspector at the facility that is the subject of this Notice, within 30 days of receipt of this Notice of Violation (Notice).
