ENCLOSURE 1 NOTICE OF VIOLATION 1

Northeast Nuclear Energy Company Docket No.: 50-336 Millstone Nuclear Power Station License No.: DPR-65 Unit 2 During an NRC inspection conducted on August 18, 1993 through September 28,1993, a violation of NRC requirements was identined. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the i

violation is listed below:

A.

Millstone Unit 2 Technical Speci6 cation 6.8.1 requires that procedures covering station activities shall be established and implemented. Station Administrative Control Procedure ACP-QA-3.02E, " Procedure Compliance," and Surveillance Procedure SP-2404 AO, " Spent Fuel Pool Radiation Monitors RM8139, 8142, 8156, And 8157 Calibration," were established pursuant to the above.

Procedure ACP-QA-3.02E requires, in part, that the intent and direction of procedures shall be followed, and that deviation from procedures is not permitted.

Surveillance Procedure SP-2404AO, Steps 6.3.3 and 6.12.9, require the seismic brace in the count rate module of radiation monitor RM-8156 to be removed and reinstalled, respectively, during instrument calibration.

l Contrary to the above, during performance of procedure SP-2404AO on July 14, i

1993, the seismic brace in the count rate module of radiation monitor RM-8156 was not reinstalled during instrument calibration. The radiation monitor remained in this degraded condition until the discrepancy was identi6ed and corrected during a i

regularly scheduled annual calibration on September 13, 1993.

Millstone Unit 2 Technical Specification 4.0.5 requires, in part, that Inservice Inspection of ASME Code Class 3 compcaents shall be performed in accordance with Section XI of the ASME Boiler and Pressure Vessel Code and applicable Addenda as l

required by 10 CFR 50, Section 55a(g), except where specific written relief has been granted by the Commission pursuant to 10 CFR 50, Section 55a(g)(6)(i).

ASME Code Section XI (1980) edition, Winter 1981 Addenda, Article IWF-2000 requires, in part, aat Inservice examinations of component supports shall be performed in accordance with Table-lWF-2500-1.

Contrary to the above, as of September 14, 1993 the suction piping supports of the auxiliary feedwater system, were not included in the Millstone Unit 2 ASME Code Section XI, Inservice Inspection Program; and had not been subjected to the Inservice examinations of Table-IWF-2500-1.

This is a Severity Level IV Violation (Supplement I)

Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and if applicable, a copy to the NRC Resident Inspector j

within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This i

reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
