ENCLOSURE 1 NOTICE OF VIOLATION

Northeast Nuclear Energy Company

- Docket Nos: 50-245;50-423 Millstone Nuclear Power Station License Nos: DPR 21; NFP-49 Units 1 and 3 EA 98-278

'During an NRC inspection conducted on January 1,'1998, through February 28,1998, violations of NRC requirements were identified, in accordance with the " General

. Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violations are listed below:

A.

_ Technical Specification 6.8.1.a requires that written procedures be established,

' implemented and maintained covering the activities referenced in Appendix A of Regulatory Guide 1.33, February 1978, item 1c, Administrative Procedures,

~ " Equipment Control."

Contrary to the above, on February 25,1998, the NRC determined that written equipment control procedures were not established to process revisions to system valve lineups and thereby ensure that the appropriate changes are communicated to the field.

This is a Severity Level IV violation (Supplement l} for Docket No. 50-245.

~10 CFR 50.49 (a) requires each licensee to establish a program for qualifying the electric equipment important to safety (Millstone Unit 3 EQ program) as defined in 10 CFR 50.49 (b).10 CFR 50.49 (b) included nonsafety-related electric equipment whose failure under postulated environmental conditions could prevent satisfactory accomplishment of safety functions specified in subparagraphs (1) through (iii) of section (b) (1) of 10 CFR 50.49.

l Contrary to the above, as of February 10,1998, there were 21 nonsafety-related solenoid operated valves (SOV) in the high pressure and low pressure safety injection systems and four nonsafety-related SOVs in the reactor coolant system (RCS), and their associated cables whose failure under postulated environmental conditions could prevent satisfactory accomplishment of safety functions specified in subparagraphs (1) through (iii) of section (b)(l) of 10 CFR 50.49, that were not included in the Millstone Unit 3 EQ program.

. This is a Severity Level IV violation (Supplement l} for Docket No. 50-423.

'10 CFR 50; Appendix B Criterion XVI Corrective Action requires, in part, that

. measures shall be established to assure that conditions adverse to quality such as nonconformances are promptly identified and corrected.

Contrary to the above, from April 1995 to November 1996, a nonconformance with an assumption of the accident analysis for a' steam generator tube rupture was not L

promptly corrected. Operating crews at Millstone 3 were unable to complete actions in the Emergency Operating Procedures to isolate a steam generator on tube rupture. This is a Severity. Level IV Violation (Supplement 1) for Docket No. 50-4 23.
