l MOTION OF ATTORNEY GENERAL JAMES M. SHANNON TO AMEND HEARING SCHEDULE OR IN THE ALTERNATIVE TO SCHEDULE THE MATTERS TO BE HEARD SUCH THAT THE ATTORNEY GENERAL NEED NOT ATTEND ON CERTAIN DATES Attorney General James M. Shannon hereby moves the Licensing Board to amend the hearing schedule on the NHRERP, Revision 2, such that hearings will not be held on the date of October 2, 1987 and after 3:00 p.m. on the date of October 1, 1987. In the alternative, the Attorney General moves that the Board refrain from scheduling any matters for hearing on the aforementioned dates which concern the contentions to be litigated by the Attorney General. (E.g., SAPL Contentions 16, 31, 33, 34, 8 and 8A, ToH Contentions 3, 4, 6 and 8, and NECNP Contention RERP-8).

As grounds for this motion, the Attorney General asserts 1

l have filed an appearance in this case will be observing the 1

Jewish holiiday of Yom Kippur commencing on the late afternoon of October 2 and continuing through the evening of October 3, 1987. They therefore will be unable to attend the hearing on these dates. There are no other Assistant Attorneys General in this office who are sufficiently familiar with the matters to be litigated by the Attorney General to be able to replace those Assistant Attorneys Generals who are unable to attend.

1 Respectfully submitted, l JAMES M. SHANNON Attorney General 1
