REQUEST OF ATTORNEY GENERAL JAMES M. SHANNON, SEACOAST ANTI-POLLUTION LEAGUE, NEW ENGLAND COALITION ON NUCLEAR POLLUTION AND TOWN OF HAMPTON FOR BRIEFING SC9EDULE AND HEARING ON APPLICANTS' UTILITY PLAN Massachusetts Attorney General James M. Shannon and Interveners Seacoast Anti-Pollution League, New England Coalition on Nuclear Pollution, and the Town of Hampton (collectively " petitioners") hereby request that the Commission maintain the stay of the issuance of a low-power license imposed as a result of its order of January 9, 1987 and its decisions of April 9, 1987 and June 11, 1987 and order further briefing of and a hearing on the issues raised by the applicants' September 21, 1987 filing of a utility plan for l Massachusetts. In addition, the Attorney General requests that his May 13, 1987 application to the Commission for a stay pending appeal of the on-site licensing board's Partial Initial Decision be granted.

4 A r As grounds 1for this. request, the petitioners-state that:

Briefing and Hearing 1.. On January 9', 1987, the Commission ordered review of the licensing board's decision. authorizing the issuance of a fuel loading license (and the appeal board's affirmance of that authorization) to consider whether the applicants should be required to submit radiological emergency response plans for the entire Epz before any operating license could be issued, Public Service'Co. of New Mampshire (Seabrook Station, Units 1 and 2), Order (unpublished) 1 January 9, 1987). Simultaneously, the Commission imposed-a stay on the issuance of a-low-power license.

2. On April 8, _1987, the applicants submitted documents characterized as emergency plans for Massachusetts which were, in fact, the draft Massachusetts plans earlier rejected by the state as inadequate. q
3. On April 9, 1987, the Commission ruled thtt " sound policy favors requiring the filing of a State, local, or l utility plan before any operating license is issued" and deferred ruling on the effect of the applicants' filing (and continued its stay of low-power) until the parties briefed the issues, Public Service Co. of New Hampshire (Seabrook Station, j l

Applicants could demonstrate that adequate emergency planning is in the realm of the possible.

4. On June 11, 1987, the Commission ruled that the applicants' April 8, 1987 " plans" were not a " bona fide utility plan" and did not satisfy 10 C.F.R. S50.33(g), Public Service Co. of New Hampshire (Seabrook Station Units 1 and 2),

CL1-87-03, NRC (June 11, 1987) and, therefore, kept its stay in effect.

5. On September 21, 1987, the applicants filed what they claim to be a satisfactory utility plan.  !
6. The applicants' latest filing does not satisfy 10 C.F.R. 550.33(g) or the Commission's requirements in its June  !

11, 1987 decision.

7 The April 9, 1987 and June 11, 1987 Jecisions require that the Applicants demonstrate that their plan is bona fide and that adequate emergency planning is in the realm of the i

possible. Those issues are factual in nature and, even if given only a summary review, require further briefing of the Commission and a full hearing.

Previqus Stay Application 8 .. On March 25, 1987, the licensing board authorized the issuance of a low-power license.

9. On April 6, 1987, the Attorney General appealed the licensing board's order to the appeal board and requested a stay.

1 -11. The' appeal of the licensing board's order is still before the appeal board.

12. On May 13, 1987,:the Attorney General' filed with the Commission an application for a stay on the' issuance of a low-power license'pending. appeal of the issues arising from the low-power proceeding or, as a minimum alternative, a stay to j allow the Attorney General to obtain a stay from the Court of Appeals.

13 . - The Commission has not ruled on either stay request in the Attorney General's application.

WHEREFORE, the Commission'should set a schedule.for the parties'to brief the' issues raised by the applicants' September

-21,.1987 filing of " emergency plans", schedule a hearing on

'those issues, and continue the stay of the issuance of a low-power license presently.in effect until the briefing and -

hearing are complete end the Commission renders its decision.

In addition, the Commission should grant the May 13, 1987 application for a stay pending appeal of the licensing board's order authorizing the issuance of a low-power license.
