WITHDRAWAL OF PROPOSED CIVIL PENALTY By EN 86-18 dated April 10, 1986 the Commission was notified of the intent of IE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Twenty-Five Thousand Dollars ($25,0n0) to Comonwealth Edison Company.

This action was based on a violation involving the isolation of cooling water to the bearing oil cooler for an auxiliary feedwater pump.

The licensee responded to the Notice in a letter dated May 14, 1986. After careful consideration of the circumstances, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty. However, the licensee provided a sufficient basis for the reduction of the severity level of the violation from a Severity Level III to a Severity Level IV because the safety significance of this event was less than originally considered. Because sufficient redundancy and capacity was maintained during the incident even with one auxiliary feedwater pump inoperable, the staff determined that the characterization at a Severity Level IV would be appropriate. Accordingly, the proposed civil penalty has also been withdrawn.
