PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) l will be issued on or about October 2,1987 to Commonwealth Edison Company.

This action is based on the fact that the control room ventilation system was not installed as designed and described in the FSAR. As a result, several significant air inleakage paths existed. Because of these unanalyzed inleakage paths, in the event of an accident, control room personnel could have received radiation doses in excess of those previously calculated. The failure of the l facility to match the FSAR in the absence of reviews pursuant to 10 CFR 50.59 l is the violation. The escalation and mitigation factors in the Enforcement Policy were considered and no adjustment of the base civil penalty was deemed appropriate.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Enforcement to sign this action. The schedule of issuance and notification is:

Mailing of Notice October 2, 1987 Telephone Notification of Licensee October 2, 1987 The State of Illinois will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
