PROPOSED IMPOSITION OF CIVIL PENALTY - $75,000 i This is to inform the Comission that a Notice of Violation and Proposed !
-Imposition of Civil Penalty in the amount of $75,000 will be' issued on or i about September 21, 1989 to Commonwealth Edison Company. This action is based on multiple examples of the failure.to ensure that vital area barriers l were capable of deterring intrusion. The mitigation and escalation factors-were considered and, after some factors offsetting others, the penalty was ;
escalated by 50% due to multiple examples.
It should be noted that the licensee has not been specifically informed of the !
enforcement action. The schedule of issuance and notification is:
Mailing of Notice September 21, 1989 ,
Telephone Notification of Licensee September 21, 1989 The State of Illinois will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted,
- mitigated, or imposed by Order.
