IMPOSITION OF CIVIL PENALTY - $100,000 By EN 87-108 dated December 29, 1987 the Comission was notified of the intent of OE to issue a Notice of Violation and Proposed Irposition of Civil Penalty in the amount of $100,000 to comonwealth Edison Company. This action was based or, inadequacies in the licensee's program and controls for the testing of pressure isolation valves.

The licensee responded to the Notice in a letter dated February 3, 1988. After careful consideration of the Itcensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty.

Accordingly, an Order Imposing Civil Penalty in the amount of $100,000 has been issued today. Under the tems of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
