NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION licensee:
Commonwealth Edison Company (EA 93-064)
Zion Nuclear Generating Station Docket Nos. 50-295 & 50-304 Sub.iect:
PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $50,000 will be issued on or about September 9,1993, to Commonwealth Edison Company (Zion Nuclear Generating Station).
This action is based on a Severity Level III violation, involving the August 1989 failure to perform a 10 CFR 50.59 safety evaluation for a change to the facility as described in the Final Safety Analysis Repprt.
The change consisted of maintaining open, for an extended period, a 144 ft auxiliary building missile door, thereby rendering the building ventilation system incapable of maintaining the design negative pressure relative to the outdoors.
In August 1992, after NRC prompting, a safety evaluation was performed, but the evaluation was technically deficient, and the problem went uncorrected until December 1992.
The base Severity Level III civil penalty of $50,000 was escalated 50 percent for NRC's identification of the issue, and mitigated 50 percent for the licensee's subsequent corrective actions.
These considerations resulted in a zero net adjustment to the civil penalty.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice September 9, 1993 Telephone Notification of Licensee September 9, 1993 The State of Illinois will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
