Dear Mr. Chilk:

Concerning the matter of cr oss-examination of consultants to the ACRS at licensing proceedings, we have reviewed the position set forth by-Mr. Bende,r, Chairman of the ACRS attached to your request f or cornmen t .

The State of Washington supports the position taken by the ACRS. We concur that the independent and collegial nature of the ACRS role in NRC proceedings should be preserved.

Since the recommendations by ACRS consultants are based on information already available to the licensing board there would appear to be no overruling reason to place the independence of the ACRS in jeopardy.
