CONTRACT NO. NRC-17-83-399 WITH TAYL0E ASSOCIATES: REI'tBUR$ABLE NORK-On October 18, 1983 I received a call from Mary Haller, attorney with the National Treasury Employees Union (NTEU) concerning an NRC invoice she had received for NTEU's cost share of transcripts taken at arbitration

. hearings (Bill No. 080-83,9/17/83). Under the Interim Agreement between-NRC and NTEU, the costs of transcripts taken at arbitration hearings will

. be shared equally between NRC and NTEU.

fis. Haller questioned the costs of two transcripts taken at the grievance

hearing of Raj Paul Gupta on June 30, and July 1,1983 (Tayloe Invoices No. 0283 for $833.00, and No. 0284 for $656.60). She stated that she had advised the stenographic, reporter not to type the transcripts of the two days hearings because theparties were able to settle the case, lis. Haller

-~further stated that she had not received copies of the transcripts in question and felt -that NTEU should not be billed for transcripts not requested and not received. - She agreed that the Union should pay one-half of the guaranteed minimum fee paid to Tayloe when the Government elects to dispense with the furnishing of transcripts.

I contacted Marvin Itzkowitz, NRC's attorney at" the grievance hearing,

- on 10/19/83. -He confirmed Ms. Haller's statements and said he was " surprised"

- when he received copies of the transcripts. He did not furnish cooies of the transcripts to the NTEU since the matter had been settled. He felt, however, that NRC did derive some benefit from the transcripts as he had used them for training purposes.

He also, felt NTEU should be billed only for one-half of the guaranteed minimum, which is $50.00.per day.

I have requested the Division of Accounting and Finance to cancel the billings to NTEU for Tayloe Invoices No. 0283 and 0284 and to bill the Union for one-half of the guaranteed minimum.
