SUBJECT:
. RECOMMENDATION FOR RATIFICATION OF UNAUTHORIZED PROCUREMENT, NRC-17-83-399 Tayloe Associates, NRC's Stenographic Reporting Services contractor, utilized the' reproduction and' binding services ~of Pendell Printing, Inc., during the
-Midland proceedings. On four occasions Ronald Cook, NRC's Senior Resident Inspector at the Midland Site,- placed unauthorized orders for copies of transcripts with Pendell Printing, charging the copies to Tayloe's account.
Mr. Cook's memorandum, dated' September 23, 1983, explaining the circumstances surrounding these unauthorized procurements is attached.
The dates and amounts of these orders are listed below:

.$1,437.36 These amounts represent a rate of $0.08 per page and 50.25 per brad (3 brads
. per transcript). These prices are considered reasonable since the NRC pays 50.35 per page for copies ordered through Tayloe. Tayloe Associates has agreed to act as a conduit to Pendell Printing, Inc., for payment of these outstanding bills.
In accordance with Subpart 1-1.405 of the Federal Procurement Regulations, the following determinations are hereby made:
1.
The copies of transcripts received fulfilled an NRC requirement.
2.
The NRC has derived benefit in that these copies were used:
a.
to respond to Discovery and F0IA requests; i
b.
by the NRC technical and legal staff for timely review during, the proceedings and to prepare for subsequent sessions.
