10DIFICATION NO.~ THREE (3) TO CONTRACT N0. URC-17-63-399 WITH TAYL0E ASSOCIATES This modification will, in addition to ratifying unauthorized procurement actions (see itemo to T. Hagan, 10/12/83) provide a rate per page for transcripts taken during non-regular hours and ordered for 5-and 10-day delivery for meetings of

'the. Atomic' Safety a.nd Licensing Boards, Atomic Safety and Licensing Appeal Board,s, Advisory Cohmittee on Reactor Safeguards and Commission meetings under the re-quirements of the Government in the Sunshine Act.

The rate per page was arrived at by applying the formula for non-regular hour

~ ates-used in the negotiation of the contract to the agreed upon hourly rate r

' for 5-' and 10-day delivery. The following rates were developed:

5-Day Non-Regular Hour 10-Day Non-Regular Hour S3.90 (S2.60 0 1-1/2 page rate)

.76 - 15% profit 56.73 56.20 These rates, and the formula used to arrive at these rates, were discussed with Mr. Tayloe who agreed to their inclusion in the contract.

Based on a review of the projected requirements for 5-and 10-day, non-regular hour. rates, it is estimated that the current ceiling in the contract is sufficient to cover any requirement for these items.

On August 10, 1983 John Hoyle, SECY, advised DC that they had been informally supplying Tayloe with a copy of a disclaimer page and requesting that Tayloe

' add the page to the front of public Connission meeting transcripts. Recently-Tayloe'had started retyping the disclaimer page and adding it to the page count

'for billing purposes.

In addition, there had been several instances where the

' disclaimer -page had been-improperly inserted into transcripts of closed Connission meetings.
