4 NOTICE OF VIOLATION Northust Nuclear Energy Company Docket No. 50-336 Millstone Nuclear Power Station, Unit 2 License No. DPR-65 During an NRC inspection conducted on October 19-23 and November 2-6,1992, a violation of NRC requirements was identified. In accordance with the NRC Enforcement Policy (10 CFR .

2, Appendix C), the violation is listed below:

10 CFR 61.55 (a)(8) provides requirements for determinatieri c: ajk.melide concentrations in waste for disposal and states, in part, that the concentration of a radionuclide may be determined by indirect methods, such as use of scaling factors, which relate the inferred concentration of one radionuclide to another that is measured, if there is reasonable assurance that the indirect '

methods can be correlated with actual measurements.

Contrary to the above, as of October 23,1992, and for an undetermined period of time prior to this date, an indirect method (single dip sampling of resin used in conjunction with dose rate to curie conversion factors) was used to determine the concentration of radionuclides contained in spent resins from Unit 2 that were shipped for disposal, without reasonable assurance that the -

adirect method correlated with actual measurements.

This is a Severity Level IV Violation.- (Supplement IV) .

Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit a written statement or explanation to the U. S. Nuclear Regulatory Commission, ATrN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator Region 1, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation,'(2) the corrective steps that have been taken and the results achieved, .

(3) the corrective steps that will be taken to avoid further violations; and (4) the date when full compliance will be achieved. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked, or why such action as may be proper should not be taken. = Where good cause is shown, consideration will be given to extending this response time.
