Dear Mr. Stauter:

Tnis is in reference to your October 31, 1991, letter concerning the shipment of radioactive waste from the Cushing Oil Refinery site which contains special nuclear material (SNM) enriched to an average of 7.6% U-9 5, in the letter you state that previous shipments from the Cushing site have been handled in accordance with the conditions of the Cimarron f acility license (license No. SNM.928) but acknowledge that the proposed shipment would not be in compliance with the Cimarron license. You requested the staff's agreement l with the Kerr-McGee conclusion that the shipment poses no " potential concerns." The Nuclear Regulatory Commission (NRC) staff's position on the proposed shipment is as follows:

The shipment would not be in compliance with the Cimarron facility license condition requiring that uranium solutions or con' pounds generated during the Cimarron facility decontamination which exceed 5% U-235 i enrichment be promptly degraded to below St. This condition is based on safety considerations related to the design basis of the Cimarron facility, not waste disposal. These considerations do not apply to the Cushing site. Therefore, providing that all NRC regulations applicable to the classification, packaging, shipment, and accountability of waste containing SNM are followed, the staff has no objection to the shipment of the above-referenced 7.6% enriched SNM bearing waste to a licensed lard disposal facility.
