Dear Mr. Lux:
Kerr-McGee Corporation (KMC) in its letter dated February 16. 1996, identi fied l
! a need to construct an all weather haul road on its Cushing Refinery site. !
Under the terms of license condition 11.G. KMC would potentially be required to implement radiation safety procedures that would require workers in the haul road area to be trained as radiation workers. KMC proposed establishing a limit below which radiation training requirements would not have to be implemented. To support this proposal. KMC. by letter dated May 30, 1996, submitted " Final Radiation Survey of Haul Road Corridor" (Final Survey Report). NRC staff reviewed this report ;M provided comments by letter dated August 8, 1996. KMC responded to staff w ents in a letter dated August 30, 1996. In the August 30. 1996. letter. KMC also requested that its Cushing l license be amended to remove the haul road corridor area from the license for l
unrestricted use.
l l The NRC staff has reviewed KMC's August 30, 1996, responses and request for
! license amendment. KMC's Final Survey Report, and the Draft Report on its l confirmatory survey of the haul road corridor, dated September 24, 1996. by
, the Oak Ridge Institute for Science and Education (0 RISE), and find that the area associated with the haul road corridor meets NRC's unrestricted use criteria. Thus. NRC staff finds that activities may be conducted in the haul road corridor area without implementation of the Cushing radiation safety procedures related to training workers as radiation workers. This staff finding does not include the several fenced radioactive materials areas located within the haul road corridor area.
