Dear Mr. Lux:

The U.S. Nuclear Reguhtory Commission (NRC) is considering the Kerr-McGee Corporations's request to have property released, for unrestricted use, from the Cushing Refinery Site (Cushing)

License SNM-1999. NRC is taking this action in response to Kerr-McGee's license amendment requests, dated August 30,1996, and October 24,1996, to release the four unaffected areas and i

the haul road corridor area for unrestricted use and to remove the areas from the license.

Kerr-McGee's earlier requests were revised by its letter dated November 6,1998. In that letter, Kerr-McGee requested that enly Unaffected Area 1, portions of Unaffected N.as 2 - 4 that are south of Skull Creek, and a portien the haul road corridor area partially surrounded by Unaffected Areas 2 - 4 be released for anrestricted use.

In accordance with Title 10 Code of Federal Regulations section 51.21, NRC has performed an environmental assessment of the effects of NRC releasing that property from the license for unrestricted use. A copy of NRC's environmental assessment is enclosed for your records.
