ISSUANCE OF AMENDMENT NO. 8 TO MATERIALS LICENSE NO. SNM-1999, CUSHING REFINERY SITE

Dear Mr. Lux:

l The U.S. Nuclear Regulatory Commission (NRC) has issued the enclosed Amendment No. 8 to Materials License No. SNM-1999 for the Cushing Refinery Site. This amendment is in response to Kerr-McGee Corporation's application dated November 26,1997, and supplemented by your letters dated February 5,1998, March 3,1998, and June 29,1998, which requested approval of a plan to remediate Acid Sludge Pit 4 (Pit 4). Further, Kerr-McGee Corporation in its letter dated February 10,1998, and supplemented by letters dated May 1 1998, and May 28,1998, requested authorization to place radioactive contaminated material into the radioactive material storage area (RMSA).

The following are the revisions to Materials License No. SNM-1999 based on Amendment No. 8:

1. License Condition 10 was revised to reflect title change of a division within the Kerr McGee Corporation.

2. License Condition 11.B.1 was deleted. The licensee has provided the required information related to construction of the Radioactive Material Storage Area (RMSA).

As noted below, item four, NRC staff is adding a new License Condition 11.K authori operational use of the RMSA.

3. License Condition 11.B.2 was deleted. The licensee has provided the required information related to Pit 4 remediation method. As noted below, item six, NRC staff is adding a new License Condition 11.M authorizing remediation of Pit 4.

4. License Condition 11.D was revised to specify the requirements for lapel air sampler use.

5. License Condition 11.F was revised to reflect title change of a Kerr McGee Corporation staff member.

6. License Condition 11.K was added to the license to authorize construction and operation of the RMSA 1

License Condition 11.L was added to reflect the licensee's commitment to maintain liquid effluent releases from both the RMSA and the retention pond to an annual cumulative average less than 20 percent of the effluent limits stipulated in Appendix B of 10 CFR Part 20.

8.

License Condition 11.M was added to the license to authorize remediation of Acid Sludge Pit 4, in accordance with the Acid Sludge Pit 4 Decommissioning Plan.

9.

License Condition 11.K was renumbered to 11.N, in order to accommodate three new license conditions.

All other conditions of the license shall remain the same. The revised License No. SNM-1999, which incorporates Amendment No. 8, the related Safety Evaluation, and Environmental Assessment are enclosed. Further, if you have any questions, please contact Mr. Stewart Brown at (301) 415-6605.
