Dear Mr. Brown:
Kerr-McGee Corporation (KMC) submitted a final survey report for four unaffected areas of the Cushing refinery site in June,1994. Subsequent comments from NRC and responses by KMC resulted in NRC's agreement (in December,1995) that the designated areas are unaffected by licensed operations and waste disposal. Until recently, KMC planned to dispose of certain licensed material in unaffected area 4. This would apply to soil and waste exceeding the Option i
1 limits as stipulated in the Branch Technical Position on Disposal or Onsite Storage of Thorium or Uranium Wastes from past Operations (BTP).
In August,1996, KMC notified NRC that a contract with Envirocare of Utah had been executed, and KMC was withdrawing the portion of the Decommissioning Plan for Cushing that proposed onsite burial of Option 2 waste. Soil and waste exceeding BTP Option 1 limits will be shipped to Envirocare for disposal. All soil and waste buried in unaffected areas will be below BTP Option

1 limits. KMC now requests that the four unaffected areas be released from license SNM-1999.
