Request for additional information regarding executed financial instruments (L-2019-DFA-0017)

Date: Monday, March 09, 2020 1:29:00 PM We have reviewed your letter dated December 12, 2019, transmitting executed financial instruments for decommissioning financial assurance. The letter is available in the Agencywide Documents Access and Management System (ADAMS) under Accession Number ML19351C744. Our review of your application has identified that additional information is needed.

1. In the Standby Trust Agreement, there are references to both Amendment 11 and Amendment 10. We believe the references to Amendment 10 are erroneous. Please correct the amendment numbers or explain why they are correct.
2. In the Standby Trust Agreement, there are references to December 5, 2019, and December 5, 2018. We believe the 2018 dates are erroneous. Please correct the dates or explain why they are correct.
3. In Schedule B of the Standby Trust Agreement, the dollar amount listed in the first line does not match the sum of the financial instruments listed in the evidence section. We believe the dollar amount in the first line is erroneous. Please correct the dollar amount or explain why it is correct.

The additional information requested above should be provided within 30 days from the date of this message. This information is needed to verify compliance with 10 CFR 70.25, Financial assurance and recordkeeping for decommissioning.

Pending your response, we anticipate completing our review by July 2, 2020. This date could change depending on the findings of our technical review, urgent assignments, or other factors. We will promptly communicate any significant changes to this schedule.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this message will be available for public inspection in the NRC Public Document Room or from ADAMS. The ADAMS database is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
