In response to your email request for the additional information, UUSA is providing the following information:
Factor #1: Spills of radioactive material - Since the last Decommissioning Funding Plan (DFP)
- update, has LES experienced any spills or leaks that resulted in contamination that could not be removed?
Yes. On 8/5/2020, there was a Leak in the Chemical Laboratory sink resulting in an addition of 4 sqft of fixed contamination. The total Fixed Contamination Areas at UUSA is now 75 sqft.
Factor #4: Facility modifications - Provide a narrative describing the facility whether there have been facility modifications since the previous DFP, the latest DFP should clearly describe the changes, and the detailed breakdown of costs should include decommissioning any modifications to the facility.
The recent Decommissioning Funding Cost provided in correspondence LES-20-00079 on September 3, 2020 does not include increases as a result in facility modification from the previous DFP provided in correspondence LES-19-140 on October 14, 2019. The facility has not been modified resulting in changes to the number of cascades being operated or buildings in commission, nor have we made changes to the facility that would have a relevant impact on decommissioning costs.

Hello Barry, I wanted to follow up from the earlier email (below) and cover the background information along with the basis for the request for additional information. We have reviewed your letter dated September 3, 2021, transmitting the 2020 Annual Decommissioning Funding Cost Estimate (DFCE). The letter is available in the Agencywide Documents Access and Management System (ADAMS) under Accession Number ML20255A131. Our review of your application has identified that additional information is needed.
Specifically, when updating the DFCE, the Decommissioning Planning Rule requires licensees to consider the effect of eight factors, outlined in 10 CFR 70.25(e)(2), on their DCEs. In the 2020, submittal, LES addressed the eight factors, however, the following two factors need additional information:
Factor #1: Spills of radioactive material - Since the last Decommissioning Funding Plan (DFP) update, has LES experienced any spills or leaks that resulted in contamination that could not be removed?
and
Factor #4: Facility modifications - Provide a narrative describing the facility whether there have been facility modifications since the previous DFP, the latest DFP should clearly describe the changes, and the detailed breakdown of costs should include decommissioning any modifications to the facility.
The additional information requested above should be provided within 10 days from the date of this message. This information is needed to verify compliance with 10 CFR 70.25, Financial assurance and recordkeeping for decommissioning.
Pending your response, we anticipate completing our review by February 21, 2021. This date could change depending on the findings of our technical review, urgent assignments, or other factors. We will promptly communicate any significant changes to this schedule.
In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this message will be available for public inspection in the NRC Public Document Room or from ADAMS. - 1. Since the last Decommissioning Funding Plan update, has LES experienced any spills or leaks that resulted in contamination that could not be removed?
- 2. A narrative describing the facility should be included in the DFP. If there have been facility modifications since the previous DFP, the latest DFP should clearly describe the changes, and the detailed breakdown of costs should include decommissioning any modifications to the facility.
- 3. Please confirm there has been no change in possession limits.
