CONSERVATION COUNCIL RESPONSE TO APPLICAN-'S ' REVISED PROPOSED SCHEDULE The Conservation Council of NC has reviewed the Applicants' revised proposed schedule and find it acceptable as long as it i t, understood that the latter dates (ex. Phase II Contentions) need to be flexible depending on previous deadlines and information made available. We are still not confident that the Applicant can or will meet their proposed mid-1985 fuel loading date.

We would like to have the Applicants clarify the meaning of their section on the tolling of discovery during hearings. It was our understanding that discovery was to toll the whole time the hearing was to continue (i.e. a three-week long hearing would toll discovery for the whole three weeks) and not for those particular days there happened to be a hearing (i.e. Saturday and Sunday would count towards the lh days for a discovery response). ,

Besides this one difference the Applicants' revised proposed schedule represents our agreement.
