MEMORANDUM FOR THE PARTIES I spoke with Mr. Eddleman this morning and learned that Mr. Runkle is out of the country for perhaps ten days, raising a question about his ability to file a timely reply to the WB-4 responses by May 26. Mr.

Eddleman will file a reply to the responses by that date. However, he is not in a position to reply for Mr. Runkle on factor (1) -- the " good cause for late filing" issue. It is important that the admissibility of WB-4 be resolved expeditiously and the " good cause" issue should have been developed more fully by Mr. Runkle and Mr. Eddleman in the first place. In these circumstances, I asked Mr. Eddleman to tell Mr. Runkle to call me as soon as he is available, assuming he will be available on or before the 26th. If Mr. Runkle wishes to add to Mr. Eddleman's reply in other respects or provide some further explanation of the lateness of the WB-4 submission, the Board will arrange a telephone conference of
