E Comments on Chan Van Vo / CP&L Settlement -- Open Version I received the transcript of 12/17 today and by oral order of the Board (untranscribed conference with Judge Kelley and Applicants' attorney Flynn of 12-20) have until 12/28/84 to respond.
As to the on-the-record comments about the cost of litigating such claims, I understand the Department of Labor hearing on this matter was scheduled for mid-November, so that there was not much time to litigate in.
As to the on-the-record claim that the Department of Labor could not substantiate Mr. Van Vo's allegations, the dol letter (Applicants' Exhibit E) states 'We could not substantiate item 3 above"'; item 3 states " Finally, the alleged discrimination arose because the employee participated in a Nuclear Regulatory Commission Proceeding under the Energy Reogganization Act of 1974."
Item 2 is "You must have been 8a, discharged or otherwise discriminated against with respect to compensa-

These are the 3 factors for a valid conplaint, says Dol.
n Then after listing the factors they say they can't prove the third.
I'm advised the third factor is a misreading, that any safety-related mmo concerns being pursued would qualify.
